By accessing or using TopEaglerServers, you agree to be legally bound by these Terms and all terms incorporated by reference. If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time, with or without notice. Your continued use of the Service after any modifications constitutes your acceptance of the updated Terms.

• •Transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.

• •Introduce viruses, worms, Trojan horses, or other harmful code into the Service.
• •Attempt to reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Service or any part thereof, except and only to the extent that such activity is expressly permitted by applicable law.
• •Interfere with or disrupt the Service, servers, or networks connected to the Service.
• •Use any robot, spider, scraper, or other automated means to access the Service for any purpose without our express written permission.
• •Create multiple accounts to manipulate the server voting system.
• •Submit fake server listings or provide false information about servers.

TopEaglerServers is a platform that allows users to list and discover Eaglercraft servers. When you submit a server listing, you represent and warrant that:

• •You are the owner of the server or have the necessary rights and permissions to list it on our platform.
• •All information provided about the server is accurate, truthful, and not misleading.
• •The server and its content comply with all applicable laws and regulations.
• •The server does not contain material that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.

We reserve the right to remove any server listing that violates these Terms or that we determine, in our sole discretion, is otherwise inappropriate for our platform.

The following terms apply specifically to the use of EaglerHost, our server hosting platform. By using EaglerHost, you agree to these additional terms in addition to all other provisions of these Terms.

Server Management and Access

We reserve the right to inspect, monitor, suspend, or permanently delete any hosted server at any time, for any reason, without prior notice. This includes, but is not limited to, servers that we believe violate these Terms, consume excessive resources, or pose a security risk.

Prohibited Hosting Uses

• •Hosting or distributing illegal content of any kind.
• •Running cryptocurrency miners or any non-Minecraft-related processes.
• •Using hosted servers to launch attacks against other systems or networks.
• •Attempting to bypass resource limits or exploit the hosting infrastructure.

Data and Backups

You are solely responsible for maintaining backups of all server data, including but not limited to world files, configurations, plugins, and any other content stored on your hosted server. We make no guarantees regarding the availability, integrity, or preservation of your server data. We are not liable for any data loss, corruption, or unavailability, regardless of cause.

Resource Limits and Modifications

We may impose, modify, or enforce resource limits, usage restrictions, or server configurations at any time without notice. This includes changes to RAM allocation, storage limits, player caps, and any other server parameters.

Termination of Hosting

Upon termination of your account or any individual hosted server, whether by you or by us, all associated server data may be immediately and permanently deleted without any obligation to provide a data export or recovery period. We are under no obligation to retain or return your server data following termination.

This section applies to all paid services offered through TopEaglerServers and EaglerHost, including but not limited to credits, server upgrades, and premium features.

Age Requirements

You must be at least 18 years of age to make purchases on our platform. If you are under 18, you must have explicit permission and consent from a parent or legal guardian before making any purchase. By completing a purchase, you confirm that you meet these requirements.

Parents and legal guardians are responsible for monitoring their minor children's use of our Service, including any purchases made. If you allow a minor to use your account or payment information, you accept full responsibility for all purchases made by that minor.

All Sales Are Final

All purchases of digital services, including credits, server upgrades, and premium features, are final and non-refundable. Due to the nature of digital goods and services, we do not offer refunds once a purchase has been completed and the service has been delivered.

Chargeback Policy

Initiating a chargeback or payment dispute with your bank or payment provider without first contacting us to resolve the issue is a violation of these Terms and will result in:

• •Immediate and permanent termination of your account and all associated services.
• •Forfeiture of all credits, server data, and any other digital assets associated with your account.
• •Being permanently banned from creating new accounts or using our services.
• •Potential legal action to recover the disputed amount plus any fees incurred.

Unauthorized Purchases

You are solely responsible for maintaining the security of your account and payment information. Claims that a purchase was made without your authorization, including claims that a minor used your payment information without permission, will not be accepted as grounds for a refund or chargeback reversal. It is your responsibility to:

• •Keep your account credentials and payment information secure.
• •Monitor your account for unauthorized activity.
• •Supervise minors who may have access to your devices or payment methods.

Dispute Resolution

If you have any issues with a purchase, you must contact us at [email protected] before initiating a chargeback or dispute with your payment provider. We are committed to resolving issues fairly and promptly. Failure to contact us first will be considered a violation of these Terms.

The Service and its original content, features, and functionality are owned by TopEaglerServers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

We respect the intellectual property rights of others. If you believe that material available on our Service infringes your copyright, please contact us using the information provided at the end of these Terms.

Your Use of the Service

Your use of the Service is at your own risk. We do not guarantee that the Service will be secure or free from bugs or viruses. You are responsible for configuring your devices and information technology to access the Service, and we do not guarantee the continued availability of the Service.

We may update the Service from time to time, but we are not obligated to do so. We reserve the right to modify, suspend, or discontinue the Service or any part of it at any time, with or without notice to you.

We are not responsible for any servers listed on our platform. We do not endorse, guarantee, or control any of the servers listed, and we are not responsible for any content, experiences, or interactions you may have with these servers or their operators.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, OR THAT THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS.

WE MAKE NO GUARANTEES REGARDING UPTIME, DATA INTEGRITY, DATA AVAILABILITY, OR THE PRESERVATION OF ANY CONTENT OR DATA STORED ON OR TRANSMITTED THROUGH THE SERVICE, INCLUDING BUT NOT LIMITED TO EAGLERHOST HOSTED SERVER DATA. YOU ASSUME ALL RISK ASSOCIATED WITH YOUR USE OF THE SERVICE AND ANY DATA YOU STORE ON OR TRANSMIT THROUGH IT.

Limitation of Liability

To the maximum extent permitted by law, in no event shall TopEaglerServers, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• •Your access to or use of or inability to access or use the Service.
• •Any conduct or content of any third party on the Service, including servers listed on our platform.
• •Any content obtained from the Service.
• •Unauthorized access, use, or alteration of your transmissions or content.
• •Any data breach, security incident, hacking event, or unauthorized access to our systems or your account data, regardless of whether we were negligent.
• •Loss, corruption, or unavailability of any data stored on or transmitted through the Service, including EaglerHost server data.
• •Any delay or failure in notification of a data breach or security incident.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

YOU ACKNOWLEDGE THAT BY USING THE SERVICE AND PROVIDING PERSONAL INFORMATION ONLINE, YOU ASSUME THE INHERENT RISK THAT SUCH INFORMATION MAY BE ACCESSED BY UNAUTHORIZED THIRD PARTIES, AND YOU AGREE THAT WE SHALL NOT BE LIABLE FOR ANY SUCH UNAUTHORIZED ACCESS.

Termination

We may terminate or suspend your access to the Service at any time, for any reason, including if we reasonably believe that you have violated these Terms. You may also delete your account at any time. We reserve the right to maintain copies of information related to you and your use of the Service to the extent required by law or as necessary for our legitimate business purposes.

Upon termination, your right to use the Service will immediately cease. All EaglerHost server data, including server files, configurations, plugins, and world data, may be immediately and permanently deleted without any obligation to provide a data export, backup, or recovery period. We are under no obligation to retain or return any of your data following termination for cause.

The following provisions will survive termination: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Jurisdiction, and any other provisions that by their nature should survive termination.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, epidemics, pandemics, power outages, internet or telecommunications failures, DDoS attacks or other cyberattacks, hosting provider or infrastructure outages, hardware or software failures, or government actions or restrictions.

Indemnification

You agree to defend, indemnify, and hold harmless TopEaglerServers, its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms shall be resolved exclusively in the state and federal courts located in the State of Delaware, United States. You consent to the personal jurisdiction of such courts and waive any objection to the exercise of jurisdiction by such courts.

Changes to These Terms

We reserve the right to modify these Terms at any time, at our sole discretion, with or without notice. Changes will be effective immediately upon posting to the Service. The date at the top of these Terms indicates when they were last revised. It is your responsibility to review these Terms periodically for updates.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must immediately stop using the Service.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be struck from these Terms, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TopEaglerServers regarding your use of the Service and supersede all prior agreements and understandings, whether written or oral.
